1. Introduction

InnoDIGI respecte les droits de propriété intellectuelle d'autrui et attend des utilisateurs de ses services qu'ils fassent de même. La présente politique Notice and Takedown décrit nos procédures de traitement des plaintes pour atteinte au droit d'auteur.

2. Signalement d'une atteinte au droit d'auteur

Si vous estimez que votre œuvre protégée par le droit d'auteur a été copiée d'une manière qui porte atteinte à ce droit et qu'elle est accessible via nos services, nous vous prions de fournir les informations suivantes à notre agent des droits d'auteur désigné :

  • Une signature physique ou électronique du titulaire du droit d'auteur ou d'une personne autorisée à agir en son nom.
  • Une description de l'œuvre protégée par le droit d'auteur dont vous affirmez qu'elle a été violée.
  • Une description de l'endroit où se trouve, sur nos services, le matériel dont vous affirmez qu'il porte atteinte à ce droit.

  • Une déclaration de votre part attestant que vous croyez de bonne foi que l'usage contesté n'est autorisé ni par le titulaire du droit d'auteur, ni par son agent, ni par la loi.
  • Une déclaration de votre part, faite sous serment, attestant que les informations ci-dessus figurant dans votre notification sont exactes et que vous êtes le titulaire du droit d'auteur ou que vous êtes autorisé à agir en son nom.

3. Contre-déclaration (contre-notification)

Si vous estimez que votre contenu a été retiré ou désactivé à la suite d'une erreur ou d'une identification incorrecte, vous pouvez déposer une contre-déclaration auprès de notre agent des droits d'auteur, avec les informations suivantes :

  • Votre signature physique ou électronique.
  • L'identification du matériel qui a été retiré ou dont l'accès a été désactivé, ainsi que l'emplacement où ce matériel figurait avant son retrait ou sa désactivation.
  • Une déclaration sous serment attestant que vous croyez de bonne foi que le matériel a été retiré ou désactivé à la suite d'une erreur ou d'une identification incorrecte.
  • Vos nom, adresse, numéro de téléphone et adresse e-mail.
  • Une déclaration attestant que vous acceptez la compétence du tribunal fédéral de votre district et que vous acceptez la signification des actes de procédure émanant de la personne ayant déposé le signalement initial.

4. Politique relative aux contrevenants récidivistes

Conformément au Digital Millennium Copyright Act (DMCA), InnoDIGI résiliera, le cas échéant, les comptes des utilisateurs considérés comme des contrevenants récidivistes.

InnoDIGI respects the intellectual property rights of others and expects users of our services to do the same. This Notice and Takedown Policy outlines our procedures for addressing claims of copyright infringement.

2. Reporting Copyright Infringement

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on/via our services, please provide our designated Copyright Agent with the following information:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • A description of the copyrighted work that you claim has been infringed.
  • A description of where the material that you claim is infringing is located on our services.
  • Your address, telephone number, and email address.
  • A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  • A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

3. Counter-Notification

If you believe that your content was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notice to our Copyright Agent containing the following:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location where the material appeared before it was removed or disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your name, address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the federal court in your district and that you will accept service of process from the person who provided the original infringement notice.

4. Repeat Infringer Policy

In accordance with the Digital Millennium Copyright Act (DMCA), InnoDIGI will terminate, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers.
