1. Einleitung

InnoDIGI respektiert die geistigen Eigentumsrechte anderer und erwartet, dass Nutzer unserer Dienste dies ebenfalls tun. Diese Notice-and-Takedown-Richtlinie beschreibt unsere Verfahren zur Bearbeitung von Beschwerden über Urheberrechtsverletzungen.

2. Meldung von Urheberrechtsverletzungen

Wenn Sie der Auffassung sind, dass Ihr urheberrechtlich geschütztes Werk in einer Weise kopiert wurde, die das Urheberrecht verletzt, und über unsere Dienste zugänglich ist, bitten wir Sie, unserem benannten Urheberrechtsbeauftragten die folgenden Informationen zu übermitteln:

  • Eine physische oder elektronische Unterschrift des Rechteinhabers oder einer Person, die bevollmächtigt ist, in dessen Namen zu handeln.
  • Eine Beschreibung des urheberrechtlich geschützten Werks, dessen Verletzung Sie geltend machen.
  • Eine Beschreibung, wo sich das Material, das nach Ihrer Auffassung eine Rechtsverletzung darstellt, in unseren Diensten befindet.
  • Ihre Anschrift, Telefonnummer und E-Mail-Adresse.
  • Eine Erklärung von Ihnen, dass Sie nach Treu und Glauben davon ausgehen, dass die beanstandete Nutzung weder vom Rechteinhaber noch von dessen Beauftragtem noch durch das Gesetz genehmigt ist.
  • Eine von Ihnen unter Eid abgegebene Erklärung, dass die vorstehenden Angaben in Ihrer Mitteilung zutreffend sind und dass Sie der Rechteinhaber sind oder bevollmächtigt sind, im Namen des Rechteinhabers zu handeln.

3. Gegendarstellung (Counter Notification)

Wenn Sie der Auffassung sind, dass Ihre Inhalte infolge eines Irrtums oder einer Fehlidentifikation entfernt oder gesperrt wurden, können Sie bei unserem Urheberrechtsbeauftragten eine Gegendarstellung mit den folgenden Angaben einreichen:

  • Ihre physische oder elektronische Unterschrift.
  • Bezeichnung des Materials, das entfernt oder für den Zugriff gesperrt wurde, sowie des Ortes, an dem das Material erschien, bevor es entfernt oder gesperrt wurde.
  • Eine Erklärung unter Eid, dass Sie nach Treu und Glauben davon ausgehen, dass das Material infolge eines Irrtums oder einer Fehlidentifikation entfernt oder gesperrt wurde.
  • Ihr Name, Ihre Anschrift, Telefonnummer und E-Mail-Adresse.
  • Eine Erklärung, dass Sie sich der Zuständigkeit des Bundesgerichts in Ihrem Bezirk unterwerfen und die Zustellung von Verfahrensunterlagen durch die Person akzeptieren, die die ursprüngliche Verletzungsmeldung eingereicht hat.

4. Richtlinie für wiederholte Rechtsverletzer

In Übereinstimmung mit dem Digital Millennium Copyright Act (DMCA) wird InnoDIGI gegebenenfalls die Konten von Nutzern beenden, die als wiederholte Rechtsverletzer gelten.

2. Reporting Copyright Infringement

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on/via our services, please provide our designated Copyright Agent with the following information:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • A description of the copyrighted work that you claim has been infringed.
  • A description of where the material that you claim is infringing is located on our services.
  • Your address, telephone number, and email address.
  • A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  • A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

3. Counter-Notification

If you believe that your content was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notice to our Copyright Agent containing the following:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location where the material appeared before it was removed or disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your name, address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the federal court in your district and that you will accept service of process from the person who provided the original infringement notice.

4. Repeat Infringer Policy

In accordance with the Digital Millennium Copyright Act (DMCA), InnoDIGI will terminate, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers.
