1. Introduction

InnoDIGI respects the intellectual property rights of others and expects users of our services to do the same. This Notice and Takedown policy sets out our procedures for handling complaints about copyright infringement.

2. Reporting copyright infringement

If you believe that your copyright-protected work has been copied in a way that constitutes copyright infringement and is accessible through our services, we ask you to provide our designated Copyright Agent with the following information:

  • A physical or electronic signature of the copyright owner or of a person authorised to act on their behalf.
  • A description of the copyright-protected work that you claim has been infringed.
  • A description of where the material you claim is infringing is located within our services.
  • Your address, telephone number and email address.
  • A statement from you that you believe in good faith that the disputed use is not authorised by the copyright owner, its agent or the law.
  • A statement from you, made under oath, that the above information in your notice is accurate and that you are the copyright owner or are authorised to act on behalf of the copyright owner.

3. Counter-notification

If you believe that your content has been removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our Copyright Agent, with the following information:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled, and the location where the material appeared before it was removed or disabled.
  • A statement under oath that you believe in good faith that the material was removed or disabled as a result of a mistake or misidentification.
  • Your name, address, telephone number and email address.
  • A statement that you consent to the jurisdiction of the federal court in your district and that you accept service of process from the person who submitted the original infringement notice.

4. Policy on repeat infringers

In accordance with the Digital Millennium Copyright Act (DMCA), InnoDIGI will, where applicable, terminate the accounts of users who are deemed to be repeat infringers.
